For teachers and students who would like to start a derivative startup

1.How can teachers and students set up their startups?

Due to the need for scientific research, after it has been approved  by the academic and research institute where the researcher works , he/she can work part-time for the jobs below:

  1. A post of non-operational work in a relevant research field;
  2. The main R&D technology provider of a startup or the board member.

The Derivative Startup Project Committee will evaluate suitability, efficacy, and feasibility of a startup, and determine the technical price and matters related to contribution to the University of the derivative startup.

2.What is the frequency for holding a derivative startup meeting? What is the process?

*The establishment purpose of the incubator is to consult startups and is not for companies that would like to lease office space.

2.Can we register the address of the incubator for our company?

For startups now present at the Xi-Dao Incubator, they can register their offices with the address of the incubator but this is not applicable for those present at other incubators.

3.How do incubators charge the presence of companies?

The Center consists of four incubators, Xuefu, Si-Soft, CPT Building and BoAi Bio, which are established to provide different services and thus, they have different charge standards. 4.What is the incubation process and schedule?

For the presence process, please see the Webpage. We welcome you to contact managers at the incubators for pre-talks and initial evaluations. After the application is approved and document evaluation is ratified, we will invite you to come to the evaluation meeting with your documents. Then, when an approval is granted, you can prepare for the signing of the incubation agreement. It will take about three weeks from the document evaluation to the convening of the evaluation meeting.

5.Can space at the incubator be established according to the specifications of a laboratory?

R&D Result Licensing

1.What is R&D result licensing? What is the difference between this and early-stage technology transfers?

What is R&D result licensing? What is the difference between this and early-stage technology transfers?

Early-stage technology transfers: Objects that businesses would like to cooperate with but at present without completed results can only jointly research and develop with enterprises via industry-academia cooperation.

2.Are conditions of licensing fixed? What is the principle?

Technology transfer projects have different considerations for technologies, products, industrial characteristics and therefore, there are different licensing conditions. The basic principle is user paid, and uses non-inclusive licensing.
Loyalty: It mainly considers costs and marketability (for example, production value of future or relevant products).
Derivative loyalty: After a product is launched, derivative loyalty will be paid with a certain percentage of the total sales amount. If the PLC is long or the market share is high, then a certain percentage of the total sales amount is suggested to be used as the basis for derivative loyalty.

Help for Patent Applications

1.What are the result ownership documents?

If it is the result of a MOST project, please provide the approved list of expenses; for projects of MOEA or others, please provide sealed contracts. No documents need to be attached for results not produced by any projects.

2.Would the oral defenses or thesis submissions of MA and PhD students affect any patent application?

Oral defense of a thesis is regarded as publication. It will be given a one year novelty grievance when applying for the ROC and US patent, but in other countries, publication means the invalidity of the novelty. It is suggested that if an oral defense of a thesis is conducted before the patent application, to please ask participants and reviewers of the oral exam to sign the Confidential Consent Form for Participants in Oral Examination of Academic Dissertations  (Industry-Academia Collaboration>Industry and Academia Cooperation Related Attachment) ; the e-file or paper copy of the thesis shall be postponed for publication;  please ask the library to remove the abstract from publication.

3.Does the applicant need to be held responsible for the relevant patent application fees? What is the distribution proportion shared with the University?

At present, the University’s evaluation commission only approved full grants for patent applications in the ROC and the US. For applications filed in other countries, the applicant shall share R&D results of patent applications with the University in a proportion according to the Rules Governing the Evaluation of R&D Results.

4.How can the Inventor choose a patent firm?

If the application is sent to the Evaluation Committee, then after the application is approved, a patent application will be provided by offices which are at present incorporating with the University for labor procurement. If the Inventor would like to bear the cost on their own, they can independently look for the firm.

5.What is the initiating process for patent application if the patent is jointly owned with another unit?

In addition to the University’s patent initiation information, a photocopy of the signed agreement and the joint application form are required.

6.Is the contribution percentage registered in the IPR system related to the allocation of technology transfer loyalty?

Basically, allocation of technology transfer loyalty is decided by the technology transfer agreement.

7.What is the source of expenses for the self-paying patent?

  1. Leftover funding of projects
  2. General Expenses for the Ministry of Science and Technology Project, the MST, (They must be the R&D results of the MST projects and when writing off, the funding source from the MST must be noted.)
  3. Other funding sources must comply with the rules of the Accounting and Statistics Office.

When writing off the said expenses, please cite the project numbers of NYCU.

8.What is the limit for the selection of a technical advisor?

To avoid injustice during evaluation, the technical advisor shall not be the co-convener of the same project.

Contract signing for industry-academia cooperation

1.What are the relevant rules pertaining to the amount of early-stage technology transfers?

If  the loyalty is of an early-stage technology transfer MOST project, then initially, the loyalty needs to be declared in the application made to MOST and the expense shall be approved by them as a non-industry-academia cooperative MOST project. If the R&D results of an industry-academia cooperative project is owned independently by a business, then  an amount of no less than 15% of the research expenses plus the loyalty of an early-stage technology transfer will be allocated to the project convener according to the Rules Governing Technology Transfers of the NYCU.

2.How is loss and damage compensation made by the University regulated in the contract?

According to the MOE, if any school would like to conduct industry-academia cooperation, it shall sign a written contract with the organization with whom they are in cooperation and regulate the item below: “When a cooperative institution requires the school to present and guarantee a licensed technology and other matters do not cause infringement to others, the scope of compensation taken by the school shall be specified when an infringement occurs.

Additionally, according to the minutes of the administrative meeting of the University, for the responsibility of intentional or major faults, no pre-exclusion is allowed and the maximum amount of compensation shall be decided according to the practical situation.
