For teaching faculties and students who file patents via the Center in which the application is proved to have patent value as determined by the R&D Result Evaluation Committee, the patent application fee shall be allocated according to the table below and jointly shared by the University and the Inventor. In addition to a conditional recommendation, the maintenance fee from therein shall be paid solely by the University.

This rule shall be implemented on March 1st, 2018 (based on the Proposal Date on the IPR Management System with a Proceeded status.) Disputes arising from the old and new rules shall be individually evaluated by the “NYCU R&D Results Evaluation Committee.”

*MOEA Projects will be paid 100% during execution, and after the Project is completed and if the Evaluation Committee is approved and recommended, then the representative of the inventor shall negotiate for parts of expenses taken by the inventor before the proof of use is acquired; for conditional recommendations and projects funded by the inventor, the inventor shall be held responsible for all patent fees (including certificate receiving and maintenance annulment fees).

If there is anything not noted here, please abide by “Enforcement Rules of Patent Applications and Review of R&D Achievements .”

If the patent application is evaluated and determined by the Result Evaluation Committee as not being recommended for application but the inventor still would like to file the patent application, the applicant can file on his/her own or entrust the Center to apply. The inventor shall be solely responsible for the relevant patent fees or until the patent right becomes mature. For the following distribution of licensing, however, patent application and maintenance fees shall not be deducted from the loyalty.

The said patent applicants , regardless of the result of the internal technology transfer, shall all be registered as “National Chiao Tung University” but each inventor shall be able to enjoy “the right of attribution” and according to “Enforcement Rules of R&D Performance, Technology Transfer & Management,” the inventor is entitled to share the income derivatives generated from the IPRs of the R&D results.
